It would be an extreme surprise if it would contain 1%.
If you mean 100% (T/R-ratio 1), that’s a statistically significant difference but is not clinically relevant (see this thread).

Yes, I mean 100% T/R ratio.

OK, but I was referrring not contain the 100% due to a high difference in expected ratio and a very high sample size involved to do the CI 90% inside of the limits.

Can some agencies question the dossier?

Agencies can do everything. However, see the second point there. In the worst case, go for a referral and your chances to win are extremely high because the only condition for BE is inclusion of the CI within the limits.
